The State of Montana, like Arizona, enacted a law that reflects a compelling need; in this case its very cautious history of dealing with political corruption since the days when Anaconda Coal owned the State. Its anti-corruption laws were a model for the country and reflected the tragic consequences to democracy of unfettered money and influence in the electoral process. In American Tradition Partnership Inc v. Steve Bullock Attorney General of Montana the Court summarily reversed the Supreme Court of Montanas ruling that its law did not violate the First Amendment – this law provided that a “corporation may not make…an expenditure in connection with a candidate or a political committee that supports or opposes a candidate or a political party.” The Supreme Court of the United States stated that Citizens United v. FEC and its holding that “political speech does not lose First Amendment protection simply because its source is a corporation” has therefore been perpetuated into the stinking mess that is our current system. The Soros, Adelmans and Kochs of the world, not to mention the veiled and disguised money from all manner of dirty sources including foreign governments, are therefore enabled to gain leverage never contemplated in a democracy. Congress must act to remedy this horrific decision rendered by Justices that have no clue regarding the realities of a political campaign and the potential for corruption. Anything Sen McCain says about this is 100% correct. We scratch our heads and wonder……
